Sub:- Introducing of revised scheme entitled "Scheme to Promote
Voluntary Action
Persons with "Disabilities" reg.
Sir/Madam,
As you mare aware that DD Division of this Ministry has been administering
4 NGO Scheme since 1992-93. In order to broach the objective of
the schemes and to make it in consonance with the provisions of
PWD Act, 1995, all these schemes have been merged into one umbrella
schemes as titled above, with effect from 20.01.99. A copy
of the scheme, along with -revised norms and Annexures, is enclosed
herewith.
2.In case you are interested in availing further grants under the
revised scheme, while
submitting your
claim for 1999-2000 & onwards, please keep the following
in mind:
(a) Your application is complete in all respects as per the
application from and checklist
provided (as per annexure)
for both new and continuing projects (1st installment &
2nd
Installment).The application
should be submitted in duplicate and signed by the Authorized
Signatory.
(b) The grant will be sanctioned only after the recommendation
of the Competent Authority (as
notified from time to time)
has been received. In order to simplify the procedure, State-wise
NGO panels are being
notified shortly for this purpose, which will function through a
Nodal
Agency.
(c) (i) Application for new projects would be submitted to
the Nodal Agency (of NGOs panel)
which
would forward their recommendations/ comments (along with
inspection report)
to
the Ministry along with the application for the new project.
(ii) For continuing projects, the
application for 1st installment should be sent the Nodal
Agency
(of NGOs panel) who will check the necessary details/documents and
send
them
to the Ministry with their recommendations. The application should
be sent to the
Nodal
agency latest by 30th June and the Nodal Agency, in turn, will ensure
that the
same
is sent to the Ministry within 15 days.
(iii) For continuing projects, the application
along with requisite documents for 2nd
installments
should be sent to the Nodal Agency (of Egos pane) who will do a
physical
appraisal
of the project and send their recommendation along with inspections
report to
the
Nodal Agency latest by 30th June and the Nodal Agency latest
by 30th September
and
the Nodal Agency will ensure that the same is sent to the
Ministry within 3o days.
(d)The necessary checklist and standard calculation sheets also
being enclosed:
(c) To ensure speedy disposal of the applications
the Egos are required to fill in the
Standard
Calculation Sheet which is provided at Annexures - V
(A) For A New Egos:
The application from the Checklist and the Annexures-II & VI
respectively. The term "new" means Egos who are functioning for
at least 2 years
from the date of Registration /etc. of the organization, but
are applying for the first time
for a project. However, it will be open to the Central Govt.
to entertain the application
of any organization in relaxation of the condition. In such
cases detailed justification may
please be given.
(B) For Old (Continuing
) EgosLwho have already availed grants from the Ministry)
Application Forms and Checklist, for both 1st and 2nd installments,
are at Annexures III,
IV, VII & VIII.
3. The Organization is also required to fulfill
the following conditions:
(i) The organization in receipt of financial
assistance shall be open to inspection by an officer
of the Ministry
of Social Justice & Empowerment or the State Government or any
other
persons
authorized by them.
(ii) In the case of grants for buildings, the organization
must complete the building within a period
of two years from the
date of receipt of the first installment of grant-in-aid unless
extension
is granted by
the Central Government.
(iii) The accounts of the project shall be maintained properly
and separately and submitted as and
when required. These
shall always be open to a test check by the Controller and Auditor
General of India at
his direction.
(iv) The organization shall maintain record of all
assets acquired wholly or substantially out of
Government grant.
A Copy of such record will be forwarded to the Ministry of Social
Justice &
Empowerment every year by 10th April showing position as on 31st
March. Such
assets shall not
be disposed of encumbered or utilized for purpose other than those
for
which grants
were given without prior sanction of the Government of India>
Should the
organization ceases
to exist at any time, such properties will revert to the Government
of
India
(v) In case of building grant no portion of
the grant will be paid until the Control Authority of the
Organization has executed
a Bond in prescribed from securing to the Government of India a
prior lien on the building
for the recovery of the amount paid as grant in the event of the
building ceasing to
be applied for the purpose for which the grant was given.
(vi) When the State Government / Govt. of India have reason
to believe that the sanctioned
money is not being
utilized for approved purposes, the payment of grant may be stopped
and
the earlier not
so utilized recovered.
(vii) The organization must exercise reasonable economy in
the work of the approved project,
especially in respect
of buildings.
(viii) The organization must be open to all citizens of India
without distinction of religion, race
castes, language
or any of them.
(ix) Organization will engage maximum number of disabled
persons and will also implement
reservation for Scheduled
Castes / Scheduled Tribes/Obis/disabled persons on the lines of
instruction application
in Govt. of India. Information regarding implementation of this
condition will be incorporated
in yearly report to be furnished by the organization.
(x) No application or other similar fees shall be
charged from any students.
(XI) The grants organization shall furnish to the
Ministry of Social Justice & Empowerment
yearly progress
report of the project, including in detail both their physical and
financial
achievement on
relation to their approved project and such report shall continue
to be
furnished until
the project is completed to the satisfaction of the of the
Government of India
In the case of
continuing project these will be furnished regularly.
(ix) If the Ministry requires clarification on any
contained in the statement, the organization
shall supply it
with the time specified by the Ministry failing which the application
will not
not be considered.
(ix) All other conditions of the grants shall be prescribed
under General Finance Rules, 1963 as
amended from time
to time.
(iv) In case any NGO gets vehicle grant, they will
not be entitled to Transport Allowance.
However, purchase
of vehicle would be subject to the approval of Ministry of finance.
4. Please ensure that the application and checklist etc are filled
in by you to enable us to clear the
case speedily.

to the Ministry addressed to Dir.(DD),
by name).

SCHEME TO PROMOTE VOLUNTARY ACTION FOR PERSONS WITH DISABILITS
INTRODUCTION
-
The enactment of the People with Disabilities, Equal Opportunities
and protection of Rights Act of 1995 is a landmark legislation
and an expression of India's committed to social justice The
Scheme of the Ministry of Social Justice & Empowerment,
Government of India, simplifies and facilitates procedure for
easy access to Govt. NGOs, with the aim to widen the scope and
range of programmes. It will address the unmet needs of the
over 95% Indian citizens with disabilities who have not had
access to service so far. The Scheme of the Ministry of social

The objects of the scheme:
-
To ensure effective implementation of the Act.
-
To encourage voluntary action.
-
To create enabling environment.
-
To ensure equal opportunities, equity and social justice
to persons with disabilities.
-
To empower persons with disabilities.
-
To implement outreach and comprehensive Community-Based
Rehabilitation Programmes in urban and rural environments.
-
To enhance education opportunities at all level in all
forms.
-
To enlarge the scope of vocational and professional opportunities,
income generation and gainful occupations.
-
to support all such measures as may be necessary for promoting
formal as well as non formal employment and placement opportunities.
-
To support people with disabilities in project which are
environment friendly and Eco promotive.
-
To support effort to protection of human, civil and consumer
rights to persons with disabilities.
-
To support legal literacy, including legal counseling,
legal aid and analysis and evaluation and training materials.
-
To support the conduct of surveys and other forms of epidemiological
studies.
-
To support and facilitates (a) construction and maintenance
of building,(b) furniture and fixtures, and (c) installation
and maintenance of machinery and equipment
-
To support and facilitate for sport, recreation, leisure-time
activities, excursions, creative and performing arts, cultural
and socially inclusive activities.
-
To promote research in various development areas, innovate
strategies, assistive devices and enabling technologies
and support production of such devices ensuring quality
control
-
To support manpower development activities to trains required
personal at different levels for all programmes / projects
/ activities fir persons with disabilities.
-
To set up well equipped resources centers at different
levels.
-
To promote and support the development of self-help group,
parent organization and independent living.
-
To encourage coordination, cooperation and networking and
multisectoral linkages.
-
To Support such other measures, which may meet the needs
of the persons with disability and fulfil the obligations
as prescribed in the Disability Act of 1995
3.1 ELIGIBLE ORGANIZATION
1. The organization
should be:
(a) Registration under the Societies Registration Act, 1860
(XXI of 1860) or any relevant
Act of the State/Union Territory, or
(b) A public trust registered under the law for the time being
in force: or
(c) A charitable company licensed under section 25 of the
Company Act, 1958
for at least 2 years at the time of applying for grant under this
scheme in case
relaxation to this condition is required detailed justification
should be given. Secretary
(SJ&E) in empowered to waive this condition to be recorded in
writing.*

It should have a legally constituted managing body.

It is not run for profit to any individual or a body of individuals.

3.2. EXTENT OF SUPPORT
I
The quantum of support shall be determined on the scope of the project
proposal
which could be upto 90%

The norms of payment are as per Annexure (I)
III
If an organization has already received or is expecting to
receive a grant from some
other official source for a project for which application is being
made this scheme, the
grant under this scheme will be sanctioned after taking that into
account. The
application will have to give information / declaration to that
effect.
IV
The grant will be released in two installment normally. The first
installment of 50% of
the admissible amount will be released on adhoc basis, subject to
nothing adverse.
3.3 PROCEDURE FOR SUBMISSION OF APPLICATION:
(A) FOR NEW PROJECT:
The application for the new projects will be sanctioned on
the recommendation of the
State Government / State Commissioners/National Institution/Organization/any
other
system designated by the Ministry of Social Justice & Empowerment
for this purpose
on the form prescribed (Annexure-II) but for New Project dealing
with training of
professional application should submitted to RCI for approval and
support
(B) FOR CONTINUING PROJECT:
(1) Application
is to be submitted on prescribed from release of first installment
(see
Annexure III). The required documents to secure of first installment
are:-
(i) Audited/Unaudited accounts for the previous year indicating
the expenditure
incurred on each sanctioned
items vis-ΰ-vis the grant sanctioned).
(ii) Budget Estimate for the financial year for which grant-in-aid
is required (show
recurring and non-recurring
items separately).
(II) The NGO will then
apply for second and final installment after utilization of the
grant
released during the previous financial year, if any in the prescribed
format (See
Annexure -IV). The required document to secure final installment
are:-
(i) Annual Report of the previous year,
(ii) Audited statement of accounts of previous year (Receipt and
payment statements,
Income & expenditure statement and
Balance Sheet.
(iii) Audited utilization certificate with item wise expenditure
as per the sanctioned items
of grant.
(iv) Details of staff employed (as per Appendix-I)
(v) Details of beneficiaries (as per Appendix-II)
(vi) Assets acquired wholly or substantially out of government
grants under GFR 19 (as
per Appendix-III
(vii) Any other information considered necessary by the organization
or as asked for.
III The application for the
continuing projects will be sanctioned on the recommendation of
the State Government / State Commissioners / National Institution/Organization/
any other
system designated by the Ministry of Social Justice & Empowerment
for this purpose.
(a) The NGO will maintain separate account for each Scheme
/ Project.
(b) The organization will also be open to inspection by Govt. authorized
etc. and for
internal audit/concurrent audit
and audit by the CAG, whenever required.
IV. The NGO will
submit their application after calculating the required to be released
under grant-in-aid in a standard checklists, both for new as well
as continuing projects as
per Annexures VI, VII & VIII.
Annexure -I
DISABILITIES DIVISION
Norms for Scheme to Promote
Voluntary Action for Persons with Disability.
Disability Divisions has so far been administering the following
five grant-in-aid Scheme which are being implemented through NGOs:
1. Scheme of Assistance to organize
for the Disabled.
2. Scheme of Assistance to Disabled
persons for Purchase / Fitting of Aids / Appliances;
3. Scheme of Assistance to Voluntary
Organization for the Rehabilitation of Leprosy Cured persons;
4. Scheme of Assistance to Voluntary
organizations for Special School for Handicapped Children; and
5. Scheme of Assistance to Organizations
for Persons with Cerebral Palsy ands Mental Retardation.
2. I order to make these scheme more effective and better result
oriented it has been decided that
the Four Scheme mentioned at (1), (3), (4) &(5)
be replaced by the present umbrella schemes,
which incorporates all the components of the earlier
schemes and also cover the new areas in
the field of disabilities. So far as the Scheme
at (2) is concerned, it has already been revised.
After going through the earlier set of norms, it has
now decided that;
SALARY/HONORARIUM
1. There should be a fixed 'Honorarium'
to be paid to the personal of the NGO instead of 'salary'. The Government
would contribute 90% of the honorarium to the NGO.
2. As the salary structure for the
personnel of NGOs has now been discontinued, every year, the recurring
grant (only he Honorarium portion) of the NGO for honorarium would
be enhanced by 10% of the amount released in the previous year.
This would imply that every yearn there would be an increase in
the honorarium amount of the personnel involved.
3. The amount of stipend for
the hostlers will be Rs.600/- and for the locals coming from far
away places during time will be Rs
..
4. As regard Transport Allowance,
the same will be as follows:
A
Class Cities
Rs.300/- P.m
B Class Cities
Rs.250/- p.m
C Class Cities
Rs.175/- p.m
5. An amount of Rs.1000/- per beneficiary per
annum would be admissible fir medicines.
6. Exemption: The norms will not be applicable
on special cases such as involving direction of
High Courts and the Supreme Court.

7. The scope of the scheme has been amplified to such
an extent that any voluntary action for
ameliorating the plight of the disabled
will be funded by the Union Government as stipulated in
The Persons with disabilities Act,
1995. However for administrative implementation of the
scheme, a set of norms for different
projects are detailed as under. However this list is only
illustrative and not exhaustive.
8. Construction of Building
The maximum admissible limits
is Rs. 15 lakhs.
i)
Rs. 1.5 lakhs for each class room for every 10 students(or part)
ii)
Rs. 2.00 lakhs for every 1o\0 students (or part) for vocational
training or employment
centers.
iii) Hostel
building : Assistance is to be provided for construction of covered
area not
exceeding 40 sq. per beneficiary, subject to maximum of Ra.
25000/- per persons.
iv)
Proposal for additional building grant for a particular purpose
can be provided there is
an increase in the number of beneficiaries.
v)
The building grant will not allowed for less than 20 persons.
9 . Rent of Building
Such rent, which is
certified by Revenue /PWD authorities, will be allowed subject to
under
mentioned maximum limits:
A Class Cities
Rs. 10000/- Pm,
B Class Cities
Rs. 8000/p.m
C Class &
Rural Area Rs.
5000/- p.m
These rates are meant for 60 students in the school. pro- rata
increased/ decreased shall be allowed according to increase or decrease
in the number of beneficiaries.
10. Maintenance Grant
(i) One teacher every 8 student or part
thereof. in cases of mentally handicapped the student-
teacher
ratio would be 5:1, and in case of multiple disabled the same would
be 2:1
(ii) Maintenance grant for building will be
worked out @2% of the Capital Cost of the building
subject to a maximum
of Rs. 50000/- per year
(iii) One supervisory staff for a school. Two supervisory
personnel to be provided if the strength
of the school exceeds
100 beneficiaries
(iv) Contingent expenditure will be limited to Rs. 500/-
per beneficiary per year. This would
include items
such as printing stationary, telephone, water and electricity.
(v) Electricity charges can be considered separately
in the case of workshops where heavy
machinery is involved
11) Stipend to Students
Stipend for students/trainees in hostel will be sanctioned @ Rs.
600/- per month per student.
A stipend @ Rs. 500/- per month per trainee/student to be provided
for those who are not provided hostel facilities.
12) Transport Allowance
i) Transport Allowance regardless of the category of the
disability may be allowed at the rate
mentioned in sub- para (ii)
ii) Transport Allowance in proposed to be categorized as under
(per month):-
A Class Cities Rs. 300/- per child
B Class Cities Rs. 250/- per child
C Class Cities rural area Rs. 175/ per child
ii) Transport Allowance will not be paid for transporting child/handicapper
persons for coming to
the diagnostic clinic. It will be sanctioned for transporting non-resident
student/trainees to
special education centers and or vocational training centers.
iv) Purchase of a vehicle will be allowed under the scheme to the
extent of 90% of Rs. 500 lakh,
as disabled persons can not travel alone. One post each of driver
and escort will be sanctioned
for the scheme in the honorarium or Rs, 2500/- and Rs. 1500/- per
month respectively. This is
subject that an NGO can either avail of the Transport Allowance
or the vehicle & not both
Purchase of vehicle would be subject to the approval of Ministry
of Finance.
13) Vocational Training
(i) Staff and equipment for Vocational Training units are to be
sanctioned according to the
requirements. there could be a provision for typewrites, computers
etc in the vocational
training centers and special school so that the students could
avail the training facilities.
(ii) In the case of Vocational Training Centers where heavy machines
consuming substantial
amount of electricity are in use. extra funds for electricity charges
can be sanctioned on
actual consumption basis
(iii) An amount of Rs. 1000/- per trainee per year will be sanctioned
under the scheme for
vocational training
14) Furniture and Office Equipment
i) One table and chair for each student trainee @ Rs. 2000/- per
set.
ii) One table and a chair for each staff sanctioned @ Rs. 2000/-
per set. 2-6 extra chairs is
asked for @ Rs.800/-
iii) One cupboard for each group of ten student / trainees (or
part) @ Rs. 5000/- each.
iv) One cupboard for each supervisory staff sanctioned @ Rs 5000/-
each.]
v) One cot, mattress, bed sheet, pillows blanket , etc for each
student in hostel @ Rs.2000/- for
each student
vi) One typewriter for a group of 40 student for office use. More
than two typewriters are not be
sanctioned. If an institution has 100 students or more than a computer
with printer may be
sanctioned with in the limit of Rs. 1 lakh
vii) List if equipment and office furniture and equipment to be
provided under general scheme
should be comprehensive and frequency of its replacement specified
as once in every three
years.
15) Equipment for Sports
Equipment for sports shall be provided up to an amount of Rs. 20000/-
once in every three years. Excursion trip once in year, may also
be allowed upto an amount of Rs. 15000/-.
PT/OT/ Speech therapy equipment/special education material, item
which are approved by National Institute, would be funded up to
90% of the cost. Beside expenses met on music, dance, painting also
would be funded 90% of the cost.
Purchase of library books up to the extent of Rs. 1 lakh will be
met by the Ministry once in five years.
16) Seminars /Workshop/Rural Camps.
Support and finance of seminar / workshop/rural camps by NGOs would
be considered on merit
of each proposal to the maximum of Rs. 100000/- once in a year.
17) In order to facilitate the NGOs ample mobility with regard
to the disabled beneficiaries, a one-
time grant for vehicle to the tune of 90% of Rs. 5.00 lakhs will
be sanctioned to the NGOs.
One post of driver (honorarium Rs 3000/- p.m) and one helper (honorarium
Rs 2000/- p.m)
will be sanctioned, 20% of Rs. 5.00 lakhs (maximum fir maintenance
of vehicle per year
18) It has now been decided to create state level panels for monitoring
and recommending the
cases of NGOs for release of grant-in-aid. It has, therefore, been
decided that 3% of the total
budget of the scheme (i.e.3% of Rs. 46 crores for the year 1998-99)
will be earmarked for
meeting the administrative expenditure of the panels.

In addition to the payment for the CBR personnel a certain amount
of money approximately 10% of the total project cost may be kept
for administrative expensive such as typist, peon etc. The expenses
on training would be same as for other programmes, although keeping
in mind the fact the implementation of the CBR programmes involve
a lot of travelling, expenses on travel, may be accepted at the
rates which are just twice the rates suggested for other programmes.
Whenever a motorbike or bicycle is proposed to be provided to the
CBR worker, the traveling expenses will be paid only if no POL charges
are given to the worker. The personnel in CBR programme will have
to be trained. Experience will also be taken into account.

that the grant is not being utilized for approved purposes, the
Government of India may stop payment of further installment and
recover earlier grant in such manner as they decide.
(d) The institution shall exercise reasonable economy in its working
especially in respect of expenditure on building.
(e) In the case of grant for building, the construction will be
completed within a period of two years from the date of receipt
of the first installment of grant unless further extension is granted
by the Government of India.
(f) No change in the Plan of building will be made without the
prior approval of the Government of India.
(g) Progress reports on the project will be furnished at
regular intervals as may be specified by the Government.
(h) The organization will bear the balance of the estimated expenditure
on the project or the organization will bear ten percent
of the expenditure or the organization will not
bear any expenditure and the entire balance will, be borne by the
State Government; and
(i) The organization agrees to make reservation for the Scheduled
